Apple is no stranger to lawsuits, but this is not your everyday legal skirmish.

On Monday, Frank M. Fazio – an iPhone 4S owner from New York – filed suit against Apple claiming false advertising.

Represented by Robbins Geller, the man asserts that Siri is “at best, a work-in-progress” and Apple should be held accountable for distributing a “misleading and deceptive” ad campaign for the voice activated personal assistant.

In many of Apple’s television advertisements, “individuals are shown using Siri to make appointments, find restaurants, and even learn the guitar chords to classic rock songs or how to tie a tie,” the filing reads. “In the commercials, all of these tasks are done with ease with the assistance of the iPhone 4S’s Siri feature, a represented functionality contrary to the actual operating results and performance of Siri.”

Fazio is seeking “unspecified damages” from Apple.

    If your ringer is off SIRI opens and does nothing. WHY NO MESSAGE??? Took me a while to figure it out. Otherwise I think it's cool.

    What really pissed me off is that I have two iphones and a touch I use for music and wifi apps – they all work great in my Subaru, but my new phone, which is my only device with a data connection DOES NOT WORK IN Subarus. Nice one Apple, way to be backwards compatible.

    Glad to hear this.. Siri is useless!!! maybe in a few years it'll work but it is currently rubbish.. Only the hardcore apple fanboys will disagree. And deep down they know is shite as well…

    Does it ever end? Siri is great technology and with a little patient you will learn to love it too… There is a learning curve, so is there with Twiter and, eharmony. You have to teach it and just like a kid, you"ve got to teach ur 4s, it will do everything the TV commerciall says and more. works and it rocks, patients my brother , it's a mac, if it was simple everyone would have one,,,,

    Works great for me. I use Siri multiple times per day and the more I get used to it, the better it works. Frank Fazio must be tech challenged. I have tried ever single one of the things in the commercials and with practice gotten every one of them to respond with positive results. What money hungry jerk. Hope you get NOTHING Frank…..and then get sued back for making Apple respond to your frivolous claims. Moron.

    Honestly, I'm glad someone sued. I have been using an iPhone since the very first one, and I have had NOTHING but problems with 4S. I'm already on my second one and it looks like it needs to be replaced yet again. Siri does not work as advertised, but that's actually the least of my worries – there are serious battery drain issues, network/connectivity issues, countless other tiny things, wireless syncing barely works, and despite having upgraded to 5.1, none of these problems seem to be getting any better which leads me to believe they are hardware related, not just software – that or Apple's new software sucks. Either way, it's a fail. They should've waited a little longer before they put out crap. I'm pretty sold on moving to Android ASAP.
