The Battle for Samsung Product Ban is Back OnThere’s just no backing down for Apple.

Despite a federal judge’s ruling in the opposite opinion, Apple believes Samsung’s infringing products should be banned.

According to The New York Times, Apple is now moving forward with an appeal even though it won the legal battle against Samsung.

Last spring, jurors determined that Samsung must pay $119.6 million in damages pertaining to the violated Apple patents. Unfortunately for Apple, federal judge Lucy H. Koh won’t go one step further and ban the infringing products.

“Apple has not satisfied its burden of demonstrating irreparable harm and linking that harm to Samsung’s exploitation of any of Apple’s three infringed patents,”Koh wrote last week. “Apple has not established that it suffered significant harm in the form of either lost sales or reputational injury. Moreover, Apple has not shown that it suffered any of these alleged harms because Samsung infringed Apple’s patents.”

To Apple, however, that ruling isn’t acceptable. And so the appeal process will now begin.
